
Sunship LLC – Terms of Service

1) Use of our Services: By using our site, submitting a lead form, or scheduling with us, you agree to these Terms and our Privacy Policy.
2) Communications you request: When you provide your contact info, you agree we may contact you about solar products and services you inquired about via phone, text, or email. Consent is not required to purchase. Message/data rates may apply. Reply STOP to opt out of SMS; HELP for help.
3) Accuracy: You confirm the information you provide is accurate and that you’re authorized to be contacted at the provided number/email.
4) No warranties: Services and site content are provided “as is” to the fullest extent permitted by law.
5) Limitation of liability: To the extent allowed by law, Sunship, LLC is not liable for indirect, incidental, special, consequential, or punitive damages.
6) Third-party services: We may link to or integrate third-party services (e.g., scheduling, analytics, Meta lead forms). Their terms and privacy policies apply to their services.
7) Changes: We may update these Terms; the Effective Date will be shown. Continued use means you accept the changes.
8) Dispute Resolution — Binding Arbitration; Class-Action Waiver.
(a) Informal resolution first. Before filing a claim, you and Sunship, LLC agree to try to resolve it informally. Email support@sunshipsolar.com with a brief description and your contact info. If not resolved within 30 days, either party may start arbitration.
(b) Arbitration. Except for small-claims matters and requests for injunctive relief, any dispute or claim arising out of or relating to these Terms or our Services will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
(c) Seat & forum; remote hearings. The arbitration seat and venue is Denver, Colorado, but hearings may be conducted remotely by video/phone if permitted by the arbitrator/AAA rules.
(d) Small-claims option. Either party may bring an individual action in small-claims court in your county of residence or in Boulder County, Colorado instead of arbitration.
(e) Class/Jury waiver. Arbitration will be conducted only on an individual basis; no class actions or class arbitrations. You and Sunship, LLC waive any right to a jury trial.
(f) Injunctive relief in court. Either party may seek temporary or permanent injunctive relief in court to protect confidential information, intellectual property, or to stop unauthorized access/abuse. For such actions, you and Sunship, LLC consent to the exclusive jurisdiction and venue of the state and federal courts in the City and County of Denver, Colorado.
(g) Fees. AAA filing, administration, and arbitrator fees will be governed by the AAA Consumer Rules. The arbitrator may award fees/costs as permitted by law.
(h) Severability. If the class-action waiver is found unenforceable for a particular claim, that claim must proceed in court, not arbitration. This Section 8 survives termination of these Terms.
9) Governing law. These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules.
